Binding Arbitration. You and Conroe Hay Sales agree that any dispute, claim, or controversy arising out of or relating to these Terms, our services, or our SMS communications will be resolved through final and binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.
The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in, or be based on submissions from, Montgomery County, Texas, unless you and Conroe Hay Sales agree otherwise.
Class Action Waiver. You and Conroe Hay Sales agree that any arbitration or proceeding will be conducted only on an individual basis and not as a class, collective, or representative action. Neither you nor Conroe Hay Sales may bring a claim as a plaintiff or class member in any purported class, collective, or representative proceeding.
Venue. For any dispute not subject to arbitration, or where arbitration is found unenforceable, the exclusive venue will be the state and federal courts located in Montgomery County, Texas, and you consent to personal jurisdiction there.
